    6.2 You must provide accurate and up-to-date information when creating your Account.

    6.3 You are responsible for maintaining the confidentiality of your login details and for all activity under your Account.

    6.4 You must not share your Account or credentials with others. You must notify us promptly if you suspect unauthorized access to your Account.

    6.5 We may suspend or terminate your Account where we reasonably believe that:

    • you have breached these Terms;
    • your Account has been misused or accessed fraudulently; or
    • continued access would pose risk to us or others.

    7.2.1 Subscriptions are typically purchased through a third-party app store. Billing, cancellation and refund processes are governed by that app store’s terms.

    7.2.2 Fees are charged in advance for the relevant billing period.

    7.2.3 You are responsible for any fees or taxes charged by your payment provider.

    7.4.2 If you do not agree to the revised price, you must cancel before the new price takes effect.

    7.5 Refunds

    7.5.1 Subscription fees are non-refundable unless otherwise required by law or the relevant app store.

    7.5.2 Refunds must be requested through the app store where applicable.

    8. Telemetry Data and Privacy

    8.1 Telemetry Data We Collect

    Telemetry Data may include GPS traces, speed, acceleration, device orientation, lean and pitch estimates, timestamps, track details, and data from third-party loggers. Telemetry Data may be considered personal data.

    8.2 Storage of Telemetry Data

    Telemetry Data is stored using Google Firebase and Google Cloud. Data may be stored in the UK, EEA, or other jurisdictions subject to appropriate safeguards.

    8.3 Use of Telemetry Data

    Subject to your settings and applicable law, we may use Telemetry Data to:

    • operate and display core features;
    • operate and display core features;
    • calculate metrics, maps, analytics and comparisons;
    • sync data across Devices and maintain backups;
    • diagnose, investigate and resolve technical issues;
    •  improve the Service, including refining algorithms and models;
    • generate aggregated or de-identified statistics that do not reasonably identify you;
    •  comply with legal and regulatory obligations.

    8.4 Sharing Telemetry Data

    We do not sell identifiable Telemetry Data. We may share it:

    • with service providers supporting the Service;
    • in aggregated or de-identified form;
    • to comply with law;
    • with your explicit consent.

    Premium Subscription

    8.5 Premium Subscription and Telemetry Sharing Controls

    8.5.1 If you have an active premium Subscription, you will have enhanced control over how your Telemetry Data is used beyond what is strictly necessary to provide the core Service.

    8.5.2 Premium users may choose, within the App or by contacting us, to:

    • prevent the use of identifiable Telemetry Data for optional analytics, model training or product development that is not essential to your individual features; and/or
    • restrict the inclusion of identifiable Telemetry Data in datasets shared with third parties, except where sharing is required by law or strictly necessary to provide the Service (for example, with Firebase as our hosting provider).

    8.5.3 If you enable a “do not share” or similar control:

    • we may still need to store and process your Telemetry Data to provide core features you request (such as displaying your laps, syncing across Devices, or performing calculations within the App); and
    • we may continue to use Telemetry Data in aggregated or irreversibly de-identified form that does not reasonably identify you.

    8.6 Data Retention

    8.6.1 We retain Telemetry Data and other User Content for as long as reasonably necessary to provide the Service and for legitimate purposes such as security, backup, dispute resolution and compliance with legal obligations.

    8.6.2 You may delete sessions or laps within the App. Deleting data in the App may not immediately remove all copies from backup or archival systems, but we will ensure that such data is no longer actively used.

    8.7 Privacy Policy

    8.7.1 Your use of the Service is also governed by our Privacy Policy, which explains in detail how personal data is collected, used, shared and protected, and sets out your rights under applicable data protection laws, including the UK GDPR and, where relevant, the EU GDPR.

    8.7.2 If there is any inconsistency between these Terms and the Privacy Policy in relation to data protection or privacy matters, the Privacy Policy shall take precedence.

    9. User Content and License

    9.1 You retain ownership of your User Content.

    9.2 To operate the Service, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, store, reproduce, modify and display your User Content for the purposes of providing and improving the Service.

    9.3 For aggregated or de-identified data, this license may be irrevocable where lawful.

    9.4 You are responsible for ensuring that your User Content does not infringe any third-party rights.

    9.5 We may remove User Content that violates these Terms or the law.

    10. Acceptable Use and Safety

    Motorsport and Riding Safety

    10.2 Motorsport and Riding Safety

    10.2.1 Motorsport, track riding and performance driving involve inherent and unavoidable risks, including the risk of property damage, serious injury or death. You acknowledge these risks apply regardless of whether the Service is used.

    10.2.2 The Service provides data visualization and analysis only. It does not replace professional coaching, safety briefings, track rules, race regulations or your own judgement. The Service must not be relied upon as riding or driving instruction, real-time guidance or a safety system. You remain solely responsible for decisions relating to speed, line choice, braking, throttle control and all other aspects of your riding or driving.

    10.2.3 You acknowledge and agree that you are entirely responsible for your riding, driving or training activities, including situational awareness and general safety. You voluntarily assume all risks associated with those activities, whether or not the Service is used in connection with them.

    11. Third-Party Services

    11.1 The Service relies on, integrates with, or may contain links to third-party services, platforms and infrastructure (“Third-Party Services”), including without limitation:

    11.3 To the fullest extent permitted by law, we are not liable for any loss, damage, interruption, data issue or other consequence arising from your use of, reliance on, or interaction with any Third-Party Service. Your dealings with third parties are solely between you and the relevant provider.

    12. Intellectual Property

    12.1 The App, software, graphics, algorithms, and branding are owned by us or our licensors.

    12.2 You are permitted to use the App for personal, non-commercial purposes only.

    12.3 You must not copy, modify, distribute, or exploit any part of the Service without our written consent.

    13. “As Is” Basis and No Warranties

    13.1 The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we do not warrant and expressly disclaim all responsibility for:

    • the accuracy, completeness or reliability of any data, metrics, analysis, recommendations, track maps or other content produced by the Service;
    • any improvement to your lap times, performance, technique or safety;
    • the Service being uninterrupted, error-free, secure or free from defects; or
    • the Service meeting your expectations or specific requirements.

    13.2 To the fullest extent permitted by law, all implied warranties, including those relating to satisfactory quality, fitness for a particular purpose and non-infringement, are excluded.

    13.3 You are solely responsible for backing up your Telemetry Data and User Content. We do not guarantee that any data will be preserved, stored or recoverable at any time.

    14. Limitation of Liability

    14.1 Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, or for fraud.

    14.2 Subject to clause 14.1, we shall not be liable for:

    • any loss of profits, revenue, business, goodwill, opportunity or data;
    • any indirect, special or consequential loss or damage;
    • any loss or damage arising from your riding, driving or motorsport activities, whether or not the Service is used in connection with those activities;
    • any loss or damage arising from your use of, or reliance on, Third-Party Services.

    14.3 Subject to clause 14.1, our total aggregate liability to you arising out of or in connection with the Service or these Terms (whether in contract, tort, negligence or otherwise) shall be limited to the greater of:

    • £50 (fifty pounds sterling); or
    • the total Subscription fees paid by you for the Service in the twelve (12) months immediately preceding the event giving rise to the claim.

    14.4 You acknowledge that the Service is priced and provided on the basis of the limitations set out in this clause 14, and that such limitations form an essential part of the agreement between you and us.

    15. Indemnity

    You agree to indemnify us against claims and losses arising from your misuse of the Service, your breach of these Terms, your motorsport or riding activities, or any infringement arising from your User Content.

    16. Suspension and Termination

    16.1 You may cease using the Service at any time. You may delete your Account through the App (where available) or by contacting us directly.

    16.2 We may suspend or terminate your access to the Service (including your Account) immediately if:

    • you materially or repeatedly breach these Terms;
    • we are required to do so by law or pursuant to a court or regulatory order;
    • we reasonably determine that your continued use of the Service creates a risk of harm, liability or legal exposure for us or other users; or
    • we discontinue the Service in whole or in part.

    16.3 Where legally permissible and practicable, we will provide notice of suspension or termination. However, we may act without prior notice where immediate action is required, including in cases of serious misconduct, security concerns, or legal obligation.

    16.4 Upon termination:

    • your license to use the App and access the Service shall immediately cease; and
    • we may delete or anonymize your User Content, subject to any legal obligations requiring the retention of certain data.

    16.5 The provisions of these Terms that by their nature should survive termination shall continue in full force, including those relating to intellectual property, limitation of liability, indemnity and governing law.

    Governing Law and Jurisdiction

    17. Governing Law and Jurisdiction

    17.1 If you are a consumer resident in the United Kingdom, these Terms and your use of the Service are governed by the laws of England and Wales. The courts of England and Wales shall have non-exclusive jurisdiction, meaning you may also bring proceedings in your local courts if permitted by law.

    17.2 If you are a consumer resident in the European Union, you will benefit from any mandatory provisions of the law of your country of residence. You may bring legal proceedings in the courts of your home country.

    17.3 If you access or use the Service from outside the UK or EU, mandatory local consumer laws may also apply.

    18. Miscellaneous

    18.1 Severability

    If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Where possible, the invalid provision shall be interpreted to best reflect the original intent.

    18.2 No Waiver

    A failure or delay by us to enforce any provision of these Terms shall not constitute a waiver of that provision. Any waiver must be in writing and signed by us.

    18.3 Assignment

    You may not transfer or assign any of your rights or obligations under these Terms without our prior written consent. We may transfer or assign our rights and obligations to another organization, for example in connection with a merger, acquisition or business restructuring.

    18.4 Entire Agreement

    These Terms, together with the Privacy Policy and any additional terms provided within the Service, constitute the entire agreement between you and us regarding your use of the Service and supersede all prior agreements or understandings relating to the same subject matter.

    18.5 Language

    These Terms are drafted in English. If translated into another language, the English version shall prevail in the event of any inconsistency.
